The person purchasing goods sold on this website (www.officinatonazzo.it).

Subject of the contract

The sale of goods published on the pages of the website www.officinatonazzo.it. Orders can be placed via our website, by fax by completing the order form and sending it to +390498842722, or by telephone on +390497966511. All prices shown on our website include VAT and may be subject to change without notice. Shipping and payment can be made in various ways, as indicated below, at the customer's discretion.

Goods can be collected from our warehouse located at Via del Santo 174, Limena (PD), by prior telephone arrangement. In this case, no shipping costs will be charged.

Barto S.a.s. di Barzelogna Luca reserves the right to modify the description of the goods themselves, as well as the conditions of sale published on this website, without prejudice to the validity of contracts already duly concluded prior to the modification.

 

Terms and conditions

The online or telephone purchase procedure immediately generates a purchase proposal by the user. Barto S.a.s. di Barzelogna Luca, in the case of orders sent via the web, will automatically send by email confirmation of receipt of the aforementioned proposal and the information documentation required by Article 52 of Legislative Decree No. 206 of 6 September 2005, relating to consumer protection in distance contracts.

PLEASE NOTE: if you place an order via the website or by telephone and choose to pay by cash on delivery (payment in cash to the courier), and you refuse the delivery without first contacting Barto S.a.s. by email at informazioni@officinatonazzo.it or by telephone on +390497966511, you will be charged for the actual costs incurred, including shipping costs, storage costs and return of the goods, for a total amount of €20.00. The same conditions apply when the courier is unable to deliver the goods due to an incorrect or incomplete delivery address.

PLEASE NOTE: Items available in 2-5 working days

If items available in 2-5 days are ordered, this means that they are not available on the shelf and are therefore immediately ordered from the supplier.

It may happen that the supplier does not have the item available or that there are delays of another nature that we cannot control, so the wait may be extended beyond 5 days.

Unless otherwise indicated by the customer, the order will be kept on hold until the item is available again. The customer may request a refund for these items at any time.

 

Payment methods and refunds

The order is valid upon payment. Orders awaiting payment are considered valid for 8 days from the actual date of the order. After this period, they are automatically cancelled.

PAYPAL: For payments made via PayPal/credit card, PayPal's collection fees of 4% of the total amount will be added automatically.

BANK TRANSFER: If you choose bank transfer as your payment method, the goods will be shipped as soon as we receive the credit to our company account.

For all payment methods, shipping within the United Kingdom (excluding islands) normally takes place within 24/72 hours, provided that payments have been credited, the goods are available at the time of the order and the order procedure has been successfully completed (see order confirmation email).

If you have placed an order choosing to pay via PayPal and for some reason the transaction has not been successful, you can request a direct payment link by sending an email to informazioni@officinatonazzo.it specifying your order number and any other details.

PLEASE NOTE: payments sent independently, which do not correspond to the actual total of the goods ordered (e.g. missing shipping costs if required, collection fees or other) and without any communication to the company, will only and exclusively result in delays in the processing of the order.

Web prices, Vespaclub discounts or price lists reserved for workshops/retailers are ALWAYS VALID, are not retroactive and cannot be applied to orders already placed. Purchases made directly at our sales counter are subject to web prices, Vespaclub prices or retailer prices, depending on the buyer's price list.

PLEASE READ CAREFULLY: Sales invoices are not issued automatically and must be requested at the time of ordering, always and only for orders with a value equal to or greater than £80.00.

The purchasing department must be notified by telephone on 0497966511 or by email at informazioni@officinatonazzo.it of the request for an invoice.

REFUNDS: To request a refund on purchased goods, you must promptly notify Barto S.a.s. of all tax information and details relating to the order. The refund will be sent using the same payment method chosen to finalise the order and will be made by the administration.

The refund is not immediate but follows administrative procedures that can take up to a maximum of 30 days.

By sending an order to Officina Tonazzo / Barto S.a.s., you accept the terms and conditions of sale in their entirety and acknowledge the refund times.

 

Product Warranty and Returns

Pursuant to Articles 128 et seq. of Legislative Decree No. 206 of 6 September 2005, the warranty reserved solely for private consumers is valid for 2 years, while for purchases made by professionals with a VAT number, the provisions of the Civil Code apply and the warranty is valid for 12 months.

For the warranty to be valid, the product must have been used correctly, in accordance with its intended use and the provisions of the accompanying documentation; it can only be exercised if you are in possession of the original shipping documents. Parts subject to wear and tear are not covered by the warranty.

The warranty and/or replacement of products shall be void in the following cases:

  • The products have been installed or assembled by unqualified personnel;
  • The products have not been used in accordance with the parameters established by the manufacturer;
  • The products have been tampered with:
  • The products are not intact;
  • The products are not intact;
  • The products do not bear the warranty label with the serial number;
  • The products are missing their original packaging, accessories and manuals;
  • The products have been sent with inadequate packaging and the necessary precautions have not been taken to prevent one or more parts from colliding with each other, causing defects;
  • The original packaging is damaged and therefore no longer usable for reselling the goods it contains;
  • The products have been subjected to electrical discharges and voltages that do not comply with the product specifications described in the manual or on the reference plates;
  • The products have undergone unauthorised modifications and/or modifications that do not comply with the manufacturer's specifications;
  • The faults or defects have been caused by foreign parts and/or conflicts with additional components inside the same package;
  • The products have been tampered with by customers without prior authorisation;
  • The products in question are electrical spare parts that have already been installed.

To receive assistance during the warranty period, please send an email to informazioni@officinatonazzo.it indicating the nature and characteristics of the defect found and attaching all purchase documentation (delivery note, etc.).

Products must be returned in their original packaging; poorly made or improper packaging will void the warranty. Each product must be returned complete with its original accessories (cables, manuals, software, etc.) and original transport documents.

The absence of the kit means that the product is incomplete and therefore cannot be exchanged if it is deemed irreparable and therefore replaceable. To limit damage to the original packaging, we recommend, where possible, placing it in a second box; in all cases, labels or adhesive tape should not be applied directly to the original product packaging.

Any goods delivered without prior authorisation will be strictly refused and rejected. In the event of a lack of conformity, Barto S.a.s. will, at no cost to the Customer, except for transport costs, restore the conformity of the product by repairing or replacing the product, or by reducing the sale price or terminating the contract, with a consequent refund of the amount paid as consideration.

If, following intervention by an Authorised Service Centre, the defect does not constitute a lack of conformity within the meaning of Legislative Decree No. 206 of 6 September 2005, the Customer will be charged for the costs of verification and repair requested by the Authorised Service Centre, as well as the transport costs, if incurred by Barto S.a.s. di Barzelogna Luca.

Return costs shall be borne by the customer unless otherwise agreed with Barto S.a.s.

 

Right of withdrawal

In accordance with Legislative Decree No. 206 of 6 September 2005, the consumer has the right to withdraw from any distance contract, without penalty and without specifying the reason, within and no later than 14 working days from receipt of the goods. This right may only be exercised by those who purchase as natural persons for personal purposes not related to their work. The right of withdrawal is exercised, in accordance with the provisions of Article 73, paragraph 5 of Legislative Decree No. 206 of 6 September 2005, by sending, within the specified time limit, a registered letter with return receipt addressed to Barto S.a.s. di Barzelogna Luca via del Santo 174, 35010 Limena (PD). After receiving the notification, we will contact the customer to inform them of how to return the goods.

As provided for in Article 67, paragraph 3, the product is returned to the sender at the consumer's expense. No refund will be given if the goods are not intact, in their original container or packaging with adequate external packaging, if they have been used or altered, if the original accessories and documentation are missing, or if the original transport documents are not provided.

We do not accept returns that have not been agreed upon. The shipment, until proof of receipt in our warehouse, is under the full responsibility of the customer. In the event of damage to the goods during transport, Barto S.a.s. di Barzelogna Luca will notify the customer of the incident (within 5 days of receipt of the goods in its warehouses), to enable the customer to promptly file a complaint against the courier chosen by the customer and obtain a refund of the value of the goods (if insured); in this case, the product will be made available to the customer for return, simultaneously cancelling the request for withdrawal.

Barto S.a.s. di Barzelogna Luca is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the original packaging and/or packaging is damaged, Barto S.a.s. will deduct a percentage, not exceeding 10% of the refund, as a contribution to the restoration costs.

 

Processing of personal data

Legislative Decree No. 196/2003 guarantees that the processing of personal data is carried out in compliance with fundamental freedoms and the dignity of individuals, with particular reference to confidentiality and personal identity. We will process your data lawfully and fairly, in full protection of your rights and in particular your privacy.

Pursuant to Legislative Decree No. 196/2003, Barto S.a.s. di Barzelogna Luca informs you that your data will be processed for the sole purpose of executing the contract. Your data will therefore necessarily be transmitted to the shipping company with which we operate. Consent to the processing of data is necessary for the purpose of executing the sales contract. This consent will entitle Barto S.a.s. di Barzelogna Luca to inform you in the future about news, promotional discounts and initiatives. Acceptance of this method of processing is optional.

The information in our possession will not be used for any purpose other than those indicated above. The data controller is Barto S.a.s. di Barzelogna Luca, with registered office in Limena (PD), Via del Santo 174.
